
The officer most recently had a June 15, 2001 DUI charge that resulted in an alcohol blackout with a
BAC of .15 just two hours before he was to report for duty as a sniper on the Phoenix Police SWAT
team.
The officer’s creditability was withheld from the jury. His June 15, 2001 DUI charge along with two
separate excessive force charges were never mentioned.
In three trials.
In the second trial Officer Warren Brent Poole # 5011 and state witness Sergeant John White did a
demonstration in the courtroom that was completely false.
Officer Poole and Sergeant White while standing on opposite sides in front of the Judge and Jury, took
off running toward the center of the room and collided and made the jury believe that Louie ran out of his
truck and collided into the Officer at the entrance of the place of business that Louie was entering.
In the second trial Officer Poole made the jury believe that Louie was kneeling upright when he
grabbed the stick and swung it over his head and hit Officer Poole
Officer Poole testified that he had full control of Louie with his sixty pound advantage. A person kneeling
upright with another person who has their arm around the person’s neck, the person in the upright
kneeling position cannot reach ground level and grab anything. No normal human being on the face of
this earth can reach ground level from a kneeling upright position as Officer Poole testified.
Louie was in the prone position and Officer Poole was on top of him, Officer Poole having full control,
got on his knees and got Louie by the hair and his pant loop and picked Louie up a few inches like a
sack of potatoes and Louie figured that Officer Poole wanted to kill him by slamming Louie’s head into
a concrete edge. Louie with his face full of pepper spray could hardly see some sticks in front of him
and reached out and got one and swung it over his head and hit the Officer in the head causing a minor
injury and for this act of self defense Officer Poole testified that was going to shoot Louie in the back of
the head.
Crucial evidence that would have implicated Officer Poole as the aggressor was purposely destroyed
by Phoenix Police Detective James Corey. This evidence would have exonerated Luciano.
This incident would have never happened if the Phoenix Police Department internal affairs
investigators had taken their October 31st, 2001 investigation into this officer’s gross negligence and
misconduct more seriously and kept him off the streets.
In the third trial Officer Poole was asked “When did he start punching Louie”? The officer responded “I
started punching Louie after he struck me” Louie’s attorney replied, “Not so” “That’s not what you told
detective Newberry two hours after the incident” “ You told detective Newberry that you reached out and
grabbed Louie and took him to the ground and Immediately started punching him”
Also in the third trial, Louie’s attorney asked the Officer “When did you put your overhead lights on” The
Officer responded, “At third street and Grant”, Louie’s attorney responded, “Once again that is not what
you told detective Newberry, you told Newberry that Louie pulled into the alley before you could put your
overhead lights on” So basically the Officer lied to the jury so that the situation would look like a high
speed chase.
Officer Poole in his own words in the police report Admits that he attacked first, so why was this case
taken to court? He created this Injustice and did not miss any work or loose any money and yet he
asked Judge Crane McClennen for Restitution of nearly $1000.00 and he was granted the money and
we are paying Officer Poole for Assaulting Luciano Jr. This Is Justice??
